Once he got out of the vehicle, he identified himself, and the officer noticed the smell of an alcoholic beverage coming from his person. This prompted the officer to ask Acy how much he had to drink, and Acy replied, “Probably more than I should have.” When the officer observed Acy’s person, he noticed that he had very steady feet but had urine on his pants and puke running down the side of his car. He agreed to complete some field sobriety tests but later declined to do tests. Acy was then read implied consent, which he refused. The officer then obtained a search warrant, but Acy also declined to abide by the search warrant while at the ER.
